INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA **FOR CANDIDATES FOR EMPLOYMENT OR COOPERATION**
Pursuant to Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L. EU OJ L 119, p.1), hereinafter referred to as: “GDPR”), I inform you that:
- The Controller of your personal data is Packhelp S.A. based in Warsaw, ul. Kolejowa 5/7, 01-217 Warsaw, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS No.: 0000831872, NIP No.: 1231308129, REGON: 362932312 (hereinafter: “Controller”),
- Direct contact with the Controller is possible at the address of the Controller: Warsaw, ul. Kolejowa 5/7, 01-217 Warsaw at e-mail address: gdpr@packhelp.com,
- The Controller has appointed a Data Protection Officer, who can be contacted in matters related to personal data protection at e-mail address:gdpr@packhelp.com,
Your personal data will be processed:
in case of recruitment for the position indicated in the advertisement in order to conclude a contract of employment in accordance with the provisions of the Labour Code Act, i.e. on the basis of Article 6(1)(b) and (c) of GDPR in connection with Article 221 § 1 of the Labour Code Act in the scope of your first name, surname, date of birth, contact data, education, professional qualifications and previous employment history, and in the scope of personal data other than above mentioned categories, your data will be processed on the basis of your consent, i.e. on the basis of Article 6(1)(a) of GDPR,
- in the case of recruitment for a position indicated in the advertisement in order to conclude a civil-law contract on the basis of your consent, i.e. pursuant to Article 6(1)(a) of the GDPR,
- in the case of your consent, in order to conduct future recruitment processes, i.e. on the basis of Article 6(1)(a) of the GDPR,
in the case of the recruitment procedure being successful and the Company makes a decision on further cooperation, in order to take actions related to concluding a contract based on which you will provide work or services for the Company on the basis of your consent, i.e. pursuant to Article 6(1)(a) of the GDPR,
Your personal data may be disclosed to entities that support the Administrator in the course of its activities on our behalf, in particular to providers of IT and hosting services and tools, entities providing legal services, entities supporting the recruitment procedure and hiring employees, as well as the Administrator's employees and co-workers to the extent to which they are authorized to process your personal data in connection with the recruitment procedure. However, it is possible to transfer data to a third country in a situation where any of the above-mentioned entities processes data in a third country and only in a situation where the legal requirements are met, i.e. the European Commission has made a determination of an adequate level of protection or with the use of contractual clauses approved by the European Commission or in the case of possessing adequate safeguards, information about which can be made available to you,
- Providing your personal data is voluntary, but necessary to participate in the recruitment process, as required by the provisions of the Labour Code Act. Otherwise, your provision of personal data is voluntary, and in the case of processing personal data on the basis of consent, you may withdraw your consent at any time,
- Your personal data will be processed for the duration of the recruitment process, and after its completion - for a period of 2 years (for the purposes of future recruitment), if you consent to it.
You have the following rights in relation to the processing of your personal data:
- the right to access your data and to receive a copy of it,
- the right to rectify (amend) your data,
- the right to erasure (if, in your opinion, there is no basis for processing your personal data, you may request that the data be erased),
- the right to restrict the processing of personal data (you may request that we restrict the processing of personal data solely to the storage thereof or the performance of agreed actions, if in your opinion we have incorrect data or are processing it in an unfounded way, or you do not want us to delete it because it is necessary for you to assert or defend your claims, or for the duration of any raised objection to the processing),
- the right to object to the processing,
- the right to data portability (you have the right to receive from us in a structured, commonly used, machine-readable format the personal data concerning you that has been provided to us on the basis of your consent or on the basis of a concluded contract, you can have this data sent directly to another entity,
- the right to lodge a complaint to the supervisory authority (if you believe that we are processing your personal data unlawfully, you may lodge a complaint with the President of the Office for Personal Data Protection or other competent supervisory authority),
- the right to withdraw consent to the processing of personal data (at any time you can withdraw your consent to the processing of personal data processed on the basis of your consent, withdrawal of consent does not affect the legality of the processing carried out on the basis of your consent before its withdrawal).
Personal data will be processed both on paper and electronically - in IT systems, however the Administrator will not make decisions in an automated manner (including in the form of profiling).
CONSENT TO PROCESSING OF THE PERSONAL DATA OF JOB APPLICANTS
I agree for processing by Packhelp S.A. based in Warsaw, ul.Kolejowa 5/7 entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS No.: 0000831872, NIP No.: 1231308129, REGON: 362932312 (hereinafter: the "Controller") of my personal data, provided by me to the Controller in connection with the recruitment application submitted, for the purpose of conducting the recruitment process and for the purpose of taking actions related to employment, in accordance with applicable laws, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. ("GDPR") for the period of the recruitment process conducted and, in addition, for a period of 2 years from the date of completion of the process (for future recruitment).
Providing personal data is voluntary, but necessary to participate in the recruitment process. Consent for the processing of personal data can be withdrawn at any time.
